Stern Fine: In a case involving outspoken disc jockey Howard Stern, a federal judge Tuesday upheld the FCC’s procedures for fining radio and TV stations that violate decency standards. At issue were $606,000 in fines the FCC assessed Infinity Broadcasting Co. last December for remarks by Stern during his early morning program broadcast by Infinity in New York and other cities. Also fined $105,000 was Greater Media Inc., which carries Stern’s syndicated show over Los Angeles’ KLSX-FM. The judge rejected a claim by Infinity and others that the FCC’s enforcement amounts to unconstitutional censorship and prior restraint.
