Religious Gifts Suit Sent Back for Rehearing
The dismissal of a suit against the Federal Communications Commission by two contributors to television preacher Gene Scott’s Faith Center Church was reversed Tuesday by the U.S. 9th Circuit Court of Appeals and sent back for further hearing.
Norman Hahn and Rick Skogland had asked U.S. District Judge Terry J. Hatter Jr. in Los Angeles to deny the FCC access to church financial records on grounds that contributions made to a religious cause should be secret. He dismissed their action on the basis of a previous case in which the 9th Circuit court said that the FCC could examine Scott’s records.
The higher court said Hatter should formally consider the Hahn-Skogland suit and weigh their rights to religious freedom.
