JUDGE REJECTS McFLY CHAIN’S FILM SUIT
A Los Angeles federal judge on Thursday rejected an attempt by a chain of nine bar-and-grill restaurants to prevent the use of the name “McFly” in the movie “Back to the Future.”
The McFly chain, based in Monterey, Calif., sued Universal City Studios, claiming trademark infringement and that the use of the name “McFly” would confuse consumers. But attorneys for the studio argued there was no infringement and submitted declarations from the film’s screenwriters that said the name “McFly” had no connection to the bar and grills.
In her ruling, U.S. District Judge Alicemarie H. Stotler said that the movie and the restaurants were in unrelated businesses.
