A Massachusetts man accused of hitting a New York tourist three times with an aluminum baseball bat because he thought he was a Yankees fan will not serve jail time if he stays out of trouble.
The case against 21-year-old Robert Correia was continued without a finding for two years, meaning charges will be dropped if he does not get into further trouble.
Correia was charged with assault and battery with a dangerous weapon after hitting William Nestor of Northport, N.Y., with a bat after a July 4 Cape Cod fireworks show.
The Yankees and Red Sox played that weekend.
