Cemetery May Pay $625,000 to Families

A cemetery accused of topping off urns with ashes from the trash would pay a total of $625,000 to 200 families as part of a settlement.
The Daphne Fernwood Cemetery in Mill Valley also would spend $1.25 million to set up a charitable foundation to provide legal and medical services to the poor, and pay $125,000 for the plaintiffs’ legal fees.
The settlement was reached in November, but remains tentative until an arbitrator decides who should pay the legal fees of future plaintiffs in the class-action suit. Retired Judge Edward Stern said Monday he would resolve the issue in July.
