New Law Lets Condo Owners Display the Flag
Gov. Gray Davis has signed into law a bill allowing homeowners in common-interest developments to fly the American flag.
Following Sept. 11, many homeowners wanted to display Old Glory, but some condominium and townhome owners were forbidden to do so because of covenants and restrictions that govern aspects of owners’ and residents’ conduct in those developments.
Under the new law, sponsored by Sen. Dick Monteith (R-Modesto), homeowners may display the banner without fear of legal repercussions. Homeowner associations may restrict a flag display only if it is necessary to protect public health and safety.
