Allaway’s Sanity Hearing Rescheduled for Nov. 5
After prosecutors raised new allegations, a judge Friday postponed the sanity hearing for the man found innocent by reason of insanity in the 1976 shooting deaths of seven people at Cal State Fullerton.
Deputy Dist. Atty. Dan Wagner submitted tapes of recent interviews with Bonnie Sykes, the ex-wife of Edward Charles Allaway, in which she alleges rape and domestic abuse by her husband.
Wagner did not elaborate or say how the allegations might be relevant to Allaway’s condition today.
Allaway, 62, is asking to leave Patton State Hospital near San Bernardino and enter a halfway house.
His hearing was to have begun Oct. 9. Orange County Superior Court Judge Frank Fasel reset the date for Nov. 5, Wagner said, to give Allaway’s attorneys more time to review the new allegations.
