In response to the letter writer’s (Dec. 18) question, “Since when did speed limits become ‘suggested speed’ and not the law?”: The answer is when the California Vehicle Code was written. Posted speed limits under the state maximum speed have always been subject to prima facie determination, which allows a driver to exceed the posted speed upon proving that it was safe to do so under the prevailing conditions (Section 22351 (b) CVC).
