Nation IN BRIEF : NEW YORK : Parents Must OK Condom Distribution

Underage students need their parents’ permission to receive condoms from public schools, an appeals court has ruled. The Board of Education cannot dispense condoms to minor students without the consent of their parent or guardian, the state Supreme Court Appellate Division ruled. Condoms have been available in public schools since 1991. The court said the condom program violates the Constitution and public health law, which requires parental consent for health matters involving their children.
