BREA : 60-Day Limit Set on Appeals of Projects

To avoid delays of proposed projects, the City Council has tentatively approved an ordinance that sets a 60-day limit for the council to act on appeals of Planning Commission decisions.
Under the new ordinance, decisions by the Planning Commission would be final if the council fails to act on an appeal within 60 days.
The council, under current zoning laws, has no time limit on considering appeals. Once an appeal is made, the Planning Commission ruling is considered suspended, making it possible for projects to be put on hold indefinitely if the council doesn’t act or deadlocks on the appeal, officials said.
The council tentatively approved the new ordinance 4 to 1.
Councilman Glenn G. Parker, who cast the dissenting vote, argued that if the council deadlocks on an appeal, the Planning Commission should reconsider the issue.
The ordinance is expected to be adopted when the council meets on July 20 and will take effect in 30 days.
