Howard Spira’s lawyer argued before a three-judge appeals panel in New York that his client was improperly convicted of attempting to extort New York Yankee owner George Steinbrenner.
Spira was convicted last May 8 of extorting Steinbrenner and is serving a 30-month sentence at a federal prison at Morgantown, W.Va.
Spira’s lawyer, Henry Steinglass, argued that Judge Lewis L. Stanton improperly admitted into evidence a tape of a conversation between Spira and lawyer Edward Schuader after Spira’s arrest in 1990.
