Upjohn Suit Award Called Nation’s Biggest: A jury verdict against Upjohn Co. awarding more than $127 million to a man who lost an eye from a drug injection accident is the biggest personal injury award in U.S. history and one that will put drug companies on notice, the man’s lawyer said. A Cook County Circuit Court jury ordered Kalamazoo, Mich.-based Upjohn to pay Meyer Proctor of Park Forest, Ill., $3.1 million in compensatory damages and $124.6 million in punitive damages for the loss of his left eye. Punitive damages were sought on grounds that Upjohn failed to warn the medical profession about proper use of the drug. The company, which called the verdict appalling, said, “We are confident that Upjohn and its product will be exonerated of any wrongdoing.”
