Controversy Over No-Fault
No-fault insurance as it is utilized in New York and Massachusetts seems to be the solution to our insurance problems. Its primary value is in the control or elimination of excessive claims involving minor accident victims with no injuries. Seriously injured victims are still entitled to representation by an attorney and are allowed to sue, but basically no-fault would eliminate the temptation to sue regardless of justification. No-fault is opposed by attorneys only because it would affect their income.
