Superior Court Judge William D. Mudd rejected a motion from convicted killer Howard Barton that he be released on bail pending an appeal of his conviction for voluntary manslaughter in the shooting death of a man in Pacific Beach after a traffic altercation.

Barton, 48, was sentenced in March to 10 years in state prison for shooting Marco Sanchez after a minor traffic dispute between Sanchez and Barton’s daughter, Andrea Barton.

Sanchez, 24, was shot in the back on Feb. 22, 1990, in front of a Pacific Beach sporting goods store. A jury deliberated for two weeks before convicting Barton, a year to the day after Sanchez was killed.

Barton, who was represented by defense attorney Milton Silverman at his trial, has hired appellate attorney Charles Sevilla to handle his appeal before the state 4th District Court of Appeal.
