The judgment, believed to be the second-largest product liability award in U.S. legal history, was issued against the maker of Bendectin, Merrell Dow Pharmaceuticals of Cincinnati, Ohio, a subsidiary of Dow Chemical Co. The award went to an 8-year-old boy born with deformed arms and hands after his mother took the anti-nausea drug Bendectin during pregnancy. The jury in the federal trial concluded that Merrell Dow had been negligent in testing and marketing the drug and in failing to warn the public of its dangers.
