Court Won’t Force Couple to Give Up $1.7-Million Ticket

INDIANAPOLIS — An appeals court said Monday it cannot force a couple who purchased a lottery ticket worth nearly $1.7 million in another state to turn it over to the man who gave them the money to buy it.
The Indiana Court of Appeals said that the agreement made by Richard Zientara with Chester and Bernice Kaszuba to purchase the Illinois lottery ticket was illegal and unenforceable in Indiana courts.
Zientara claims that in April, 1984, he gave $4 and the winning number combination to Chester Kaszuba, a co-worker, with instructions to have Bernice Kaszuba purchase lottery tickets at the Illinois tavern where she was employed. The Kaszubas refused to give up the winning ticket after they learned it had a number combination worth $1,696,800.
