Ernest Owen McCoy, 36, sentenced to life without possibility of parole for the murder and attempted robbery of a 72-year-old liquor store clerk in 1981, has won a new trial over whether the murder was committed under special circumstances that allow him to be sentenced to life without parole. The state Court of Appeal upheld McCoy’s conviction but ruled that under a recent decision by the California Supreme Court, the trial court must examine whether he intended to kill Charles Quackenbush during the attempted robbery.
