Judge Orders Frustaci Malpractice Lawsuit Moved to Santa Monica
A lawsuit filed against a West Los Angeles doctor by Patti and Sam Frustaci, parents of the first septuplets born in the United States, Monday was ordered moved from Los Angeles to Santa Monica.
Superior Court Judge Jack Goertzen agreed with attorneys for Dr. Jaroslav Marik and the Tyler Medical Clinic that Santa Monica would be a more convenient location for witnesses expected to be called in the lengthy malpractice trial.
Goertzen also said that it is mandatory that the suit be filed in the area where the tort allegedly occurred.
The Frustacis filed suit last October claiming Marik caused the wrongful deaths of four of their seven infants through failure to properly care for the mother while she was being treated with a fertility drug in 1984.
