A New York prosecutor said that Bernhard H. Goetz, indicted for firearms offenses by a grand jury on the shootings of four youths on a subway train, may avoid a jail sentence even if he is convicted. Bronx Dist. Atty. Mario Merola said, “Under the law, if a person is found guilty, then the judge could possibly not send him to jail because of mitigating circumstances.” Normally, New York law would require Goetz, 37, to serve a minimum of one year in jail if convicted of the most serious of three weapons charges against him.
