In the Aug. 10 issue, the “Surf City council delays vote on nudity

ban” article included incorrect information regarding the 9th Circuit

Court of Appeals ruling in favor of Alameda Books in its lawsuit against

the city of Los Angeles.

The Los Angeles ordinance prohibited adult video stores from having

video viewing booths. Although there is evidence to suggest that viewing

booths in the stores may trigger lewd conduct, the court ruled that the

city’s ordinance would not be effective in eliminating that conduct

because the same conduct would probably occur if the video store was

split into two separate businesses. The court held there must be some

evidence to believe that the ordinance would be effective.
